Nakumatt allowed to operate at The Junction Mall through court order

Nakumatt on Tuesday got a court reprieve after it issued an injunction order restraining The Junction Mall owners from interfering with its operations.

Commercial Division Judge Joseph Onguto under a certificate of urgency restraining Junction Ltd, its directors, servants, from closing or interfering with the smooth operations at Nakumatt Junction.

The order directs the Junction Ltd to provide unlimited access to Nakumatt Holdings ahead of an inter partes hearing set for October 16.

Property consulting firm Knight Frank in a statement to Soko Directory maintains that “Nakumatt Holdings did not meet the terms stipulated in the Agreement by the Surrender Date of 30th September 2017.

“Nakumatt and Junction Ltd signed a surrender agreement on September 15.

However, Nakumatt did not meet all the terms,” said Knight Frank communication manager James Waithaka.

However, “The Junction will comply with the court order and will take the necessary steps to safeguard its interests.”

Nakumatt on Tuesday in a statement had faulted the Junction Mall owners stating that their eviction was in  ‘bad faith’.

Nakumatt stated that they had complied with the contents of the agreement, “We have paid Ksh 20 million to the Junction. We have taken verifiable steps to ensure that the premises are adequately restocked by 1 December 2017, including by providing approximately Ksh 64 million of stock to the branch.”
