Women will not be able to demand 50 percent of their husbands’ wealth upon separation following the ruling by the High Court.
In a ruling made on Monday, Justice John Mativo upheld the Marriage and Properties Act and rejected the Federation of Women Lawyers’ (FIDA) application that wanted section 45 (3) repealed.
Section 45 (3) of the Act states that upon separation, couples only share what they contributed together to a family wealth.
According to Justice Mativo, one cannot just walk into marriage and walk away with more than they deserved.
