Uncertainty continues to loom over Kenyan football following the Sports Disputes Tribunal’s decision on Thursday to freeze promotion and relegation in Kenya’s top three divisions. The decision throws into doubt promotions and relegations that had been determined by league position at the end of last season.
Why Was Promotion and Relegation Frozen?
The tribunal ordered the temporary suspension of promotion and relegation between the Kenyan Premier League (KPL), National Super League (NSL), and FKF Division One. The order was issued in connection with a petition challenging the implementation of FKF’s 2025 regulations for last season after the league had already commenced.
This legal dispute affects clubs that have been promoted to Kenya’s top flight, as well as reshaping the pecking order at the best betting sites in Kenya for those relegated from KPL and NSL.
FKF 2025 vs. FKF 2019 Regulations
The petition makes the argument that football kicked off last season under FKF’s 2019 regulations, and that the federation imposed the 2025 rules mid-season without following the constitutional requirements for adopting regulations within FKF. Specifically, the petition states that regulations cannot be applied mid season, which is the crux of the argument.
That legal technicality matters because KPL/National Super League teams that finished first and second are promoted automatically under both sets of regulations, with the third slot determined by a playoff. Under the 2019 regulations, one team is automatically relegated from each league, with the remaining slot determined by a playoff. Under the disputed 2025 regulations, three teams are promoted/relegated without a playoff.

Kariobangi Sharks are among the clubs caught up in the tribunal petition, as the FKF announced promotion and relegation decisions following the conclusion of last season’s league. Had the promotions and relegations been implemented immediately, the tribunal argues some decisions would become de facto permanent before the case has been heard.
Contracts, Pre-seasons and Business Decisions on Hold
Promotion and relegation affect more than just league position. Contracts with players and coaches, sponsorship agreements, pre-season friendlies, player recruitment, and budgets all depend on clubs knowing their league status for the upcoming season. As it stands, clubs (and their sponsors) do not know which division they will be playing in when the season starts. That uncertainty affects everyone involved.
Football Kenya Federation Rules OK’d By The Tribunal?
Previous tribunal rulings have questioned whether certain FKF regulations were approved by the required governance processes. It will be interesting to see how the tribunal rules now that the adoption of FKF’s regulations has become central to the case. It also remains to be seen whether this legal challenge will impact how new regulations/federation circulars are implemented in the future.
Just because the tribunal has issued an order to freeze promotion and relegation does not mean we know which clubs will move up or down. In fact, no clubs will move until further notice. The tribunal will now hear arguments in the case and determine whether FKF’s 2025 or 2019 regulations should apply.
Assuming this case doesn’t go to a higher court, the tribunal’s decision will set precedent on promotions, relegation, and which regulations govern Kenyan football.
