Presidential results announced at constituency are final – Court

The Appeals Court has ruled that presidential results declared at constituency level are final.

A three judge bench- Justice William Ouko, Patrick Kiage and Agnes Murgor  further upheld that the announced results should not be subjected to any alterations. in their Friday verdict.

The court ruled that the Chair of the  Independent, Electoral and Boundaries Commission  will only collate presidential results from 290 constituencies and declare the  total.

Appeals Court Judge William Ouko said,”Such a suggestion would introduce opaqueness and arbitrariness to the electoral process, the very mischief the constitution seeks to remedy. There is no merit in this appeal, which we accordingly dismissed.”

It further, upheld the High Court’s decision on finality of Constituency Results.

The appeal had been filed by the the IEBC who had stated that the results from the constituency have to be verified at the national tallying centre.

The court ruled that the High Court has jurisdiction to hear disputes that relate to a presidential election.
