Raila Swearing-in Unlawful, Illegal and Void  Warns Attorney General

Attorney General Githu Muigai has said it will be treason if Former Prime Minister Raila Odinga attempts to  be sworn in as President on 12 December.

The AG said it will be ‘unlawful, illegal and void ab initio’.

“The criminal law of the Republic of Kenya stipulates that sort of process is high treason. It is high treason of the persons involved, and any other person facilitating that process,” said Githu on Thursday.

“The punishment for committing treason is death. The swearing-in of any person not declared by IEBC, and who did not win the election, is unacceptable,” he said.

The Attorney General also reiterated that NASA People’s Assembly is illegal.

“The People’s Assembly is an institution unknown to the Constitution of Kenya. It is a violation of the Constitution,” he said.

“The county governments have no power to create institutions of that nature. These institutions are unconstitutional, illegal, null and void.”
