New Bill Seeks Designated Seats for Pregnant Women and Special Needs Persons

A bill that is currently in the Nairobi County Assembly is proposing that public transport vehicles have designated seats close to the alighting door for passengers with special needs and pregnant women.

The Nairobi City County Transport Bill presented in the assembly on 5th December 2019, seeks to cover passengers with physical disabilities, pregnant women, elderly persons and persons with an infant who have usually have difficulties using public transport within the city.

According to the Transport Bill, vehicles with a capacity of not less than seventeen passengers will be expected to have one designated seat.

Vehicles with a capacity of 18 to 35 passengers will be expected to have two designated seats, while those with a capacity of over 35 passengers are required to have 3 designated seats.

The bill, however, excludes the normal 14-seater matatus from the requirements.

Currently, public transport vehicles do not have designated seats for persons with special needs, a situation that’s has seen many suffer.

If the new bill is passed into law, matatus with capacities of over 17 passengers will be compelled to accommodate folding wheelchairs and walkers for the disabled.

Prohibition on Use of Force or Intimidation

The Transport Bill also proposes that the use of force or intimidation on passengers by matatu crew will attract a fine of 50,000 shillings or imprisonment of six months or both.

“No person shall use force, intimidation, threats or prevent any person from obtaining or engaging a public transport vehicle,” reads part of the Bill.
