“All children are entitled to access quality education which by law is envisaged to be overseen by ESQAC and quality assurance officers,” Dr. Galgalo stated.

The Cabinet Secretary for education prof George Magoha has been sued for failing to appoint a team to oversee the quality of Education in the country.
The case which was filed by the Chair of Education and Quality Assurance Council (ESQAC), Dr. Chris Galgalo has set a new battlefront on the quality of Competency-Based Curriculum rolled in the country
“The first respondent (Magoha) has unlawfully failed to give effect to the statutory intendment of an operational and functional ESQAC in Kenya to the detriment of not only Kenyans, but the petitioner as well and in particular in breach of his legitimate expectation,” argued Galgalo’s lawyer, Mr. Harrison Kinyanjui.
According to Dr. Galgalo, The CBC was implemented without testing. He further claims that the new curriculum lacks quality assurance because the CS has not appointed a team to do so.
The official noted that it’s not just enough for the government to provide education, rather it should ensure the students have quality teachers as well as learning materials.
The students have been learning without checks and balances of the education system according to Galgalo.
“This lack of quality assurance creates an endless curriculum learning free fall, especially those who are now faced with a new untested CBC program,” Kinyanjui said.
Court documents filed before High Court Judge Anthony Mrima, show that Dr. Galgalo was appointed by former Education minister Jacob Kaimenyi to head SQAC in 2019 and his term will end in 2023.
Mr. Galgalo went ahead to state that until now his appointment which was communicated to the Principal Secretary for Early Learning and Basic Education has not been revoked. And that means he holds an office that is not operational.
His attempt to seek intervention by charting the way forward for the agency with professor Magoha has never bored any fruit. He claims that he wrote to the CS but has since never gotten any response concerning the same.

He is now requesting the court to order prof Magoha to appoint a team to work under him, as well as order him to pay him his dues since the time he was appointed.
