The National Social Security Fund (NSSF) has told Kenyan employers that the National Social Security Act number 45 of 2013 is still in force despite a ruling by the Supreme Court on Wednesday.
The Statement by NSSF came a few hours after the Supreme Court made a ruling in a case involving the Kenya Tea Growers Association and the National Social Security Fund (NSSF) over the current enhanced rates.
In a ruling, the Supreme Court said: “It is our holding that where the Court of Appeal determines that a trial court has acted without jurisdiction in determining a matter, it cannot assume original jurisdiction over the same.”

In a reply to the court ruling, NSSF Board of Trustees in a communication Wednesday evening, acknowledged having received the ruling clarifying to Kenyans that the Supreme Court did not set aside the previous orders by the Court of Appeal.
“The Supreme Court has not lifted the Court of Appeal Orders delivered on February 3, 2023. Consequently, the National Social Security Fund Act No. 45 of 2023 remains in force,” said NSSF in a statement.
