Sarah Wairimu Cohen Released on Ksh.2 Million Bail and a List of Conditions

Sarah Wairimu, the wife of late business tycoon, Tob Cohen, has been released on a 4 million bond and two sureties with an alternative of 2 million shilling bail.

Sarah Wairimu has been ordered to, however; first provide testimonials from her parents and those who will be hosting her before she can secure her release.

Sarah Wairimu has also been ordered not to contact her late husband’s two siblings upon her release and to also not go anywhere near Tob Cohen’s business ‘Tob Ltd’.

While delivering Sarah Wairimu’s terms of release, Lady Justice Stella Mutuku on 11^th October 2019 ordered that she declares through how she would support herself.

Justice Mutuku also said that there were no compelling reasons to deny Sarah Wairimu bail which is a constitutional right unless the prosecution is able to provide sufficient reasons.

The prosecution, despite not being able to prove its reasons as to why it felt Sarah Wairimu did not deserve bail was dissatisfied with the ruling and swore to appeal.

“I have considered the compelling reasons, i find that the prosecution has not proved that she will flee from jurisdiction,”” Mutuku said.

The court was informed that the Director of Criminal Investigations (DCI) was holding Sarah Wairimu’s passport and there was no evidence to prove that the accused had another one.

Justice Mutuku also noted that Sarah Wairimu could not interfere with witnesses when she did not even know any as there was no list provided to the defense.

Sarah Cohen will not be accessing her Kitusuru house which she says she co-owns with her late husband, Tob Cohen, as it is still classified as part of investigations and remains heavily guarded

Justice Mutuku, in her ruling revealed that Wairimu had already provided an alternative place of residence where she would stay upon release.
