All Eyes Set on the Supreme Court as it Makes a Ruling

Kenyans from all walks of life are waiting with enthusiasm as the Supreme Court is set to make a ruling on Monday morning about the 26th presidential repeat polls.

“We will burn the midnight oil to ensure that we deliver judgement on Monday morning,” said Chief Justice David Maraga on Saturday.

The Supreme Court, which nullified the August 8th Presidential elections and ordered for fresh elections, completed hearings on Friday and retreated to draft the ruling.

Two petitioners, among them Former Kilome Member of Parliament Harun Mwau had gone to the Supreme Court of Kenya seeking the annulling of the October 26th polls saying that due procedures were not  followed.

The main opposition leader and National Super Alliance (NASA), Raila Odinga boycotted the elections giving an easy ride to President Uhuru Kenyatta who got more than 98 percent of the total votes cast.

Among the issues that the Supreme Court is expected to rule on include whether the Independent Electoral and Boundaries Commission (IEBC) conducted the October 26 elections in accordance with the law, whether the withdrawal of Raila Odinga had any impact on the elections and whether the IEBC was justified to proceed with the process without him, and whether the IEBC committed an offence by releasing the final tally without 26 constituencies taking part in the process.

The opposition did not challenge the elections at the Supreme Court and has opted to seek other alternative means including formation of the People’s Assemblies with already a secession Bill having been drafted.

All eyes are not set on Chief Justice David Maraga and his team of judges as he makes a ruling on Monday. The Kenya’s top court went down in history as the first in Africa and second in the world to have annulled a presidential election.
