Law Society of Kenya Protests Arrest of Suspects on Weekends

The Law Society of Kenya (LSK) has protest the current trend where the police have been arresting and detaining suspects on weekends.

LSK has termed the move as draconian because it is aimed at ensuring that the suspects remain in custody before they are charged.

The President of LSK Allen Gichuhi said that the habit of arresting suspects on a weekend goes against the fundamental rights of the accused person.

He said that the law requires a person to be presented in court within 24 hours and this cannot happen if they are arrested on a weekend.

“The rights if an accused person should be respected and accorded human dignity.” He said. “LSK, therefore, call for a meeting with the concerned authorities to reiterate the resolve of LSK to ensure that the rights of the citizens are respected and protected,” he added.

This week, the society intends to call upon the anti-corruption body to ensure that in future, “those rights under Article 49 and 50 are respected and protected.”

LSK held the annual conference in Mombasa and attended by Chief Justice David Maraga who reiterated that the Judiciary was ready, able and capable of handling the corruption cases that would be presented before it.
