The Nairobi Governor can breathe easier now after the Director of Public Prosecutions (DPP) tabled an application to withdraw assault charges leveled against him during his arrest in Voi.

The complainant, a police officer had accused Mike Sonko of assaulting him in a dramatic arrest in Voi on the 6th of December 2019.

Voi Senior resident magistrate Fredrick Nyakundi said that the complainant was no longer interested in pursuing the matter without giving any reasons but is expected to make a ruling on the matter on 22nd January 2020 at the Voi law courts.

Mike Sonko was to be arraigned on the 18th of December 2019 but his lawyers said he was unwell and on bed rest after the dramatic arrest.

Sonko had been accused of assaulting the police officer at 12.30 pm in the due execution of his duty’s contrary to section 103 of the National Police Service Act 2011, a case that has now been dropped.

Among those that had been listed as witnesses in the case are Commander Yakub and police officers James Mwanzia, Michael Muriithi, Fred Sabai, Stephen Mtawa and Ibrahim Ahmed.

Mike Sonko will now continue to face the graft allegations facing him and will be attending Court hearings in Nairobi to prove his innocence in the 19 charges facing him over the loss of 357 million shillings of County funds.

The dropping of the Mike Sonko assault case comes at a day when High Court Judge Mumbi Ngugi has disqualified herself from handling the Governor’s case where he is challenging an order issued to bar him from accessing his office.

Mike Sonko has argued the High Court Judge Mumbi Ngugi has already decided on two cases regarded access of office for public officials and he can already foretell his fate as he feels the judge is prejudiced.
