High Court Suspends Mutahi Kagwe’s Directive On Vaccine Certificate

Kenyans without vaccination certificates were to be barred from boarding the Standard Gauge Railway (SGR), planes, access to malls, hotels, and bars.

The High Court of Kenya has suspended the directive by Health CS Mutahi Kagwe of barring Kenyans from accessing basic services without a Covid-19 certificate. The order was to take effect from December 21 with millions of Kenyans to be affected.

According to Kagwe, Kenyans without vaccination certificates were to be barred from boarding the Standard Gauge Railway (SGR), planes, access to malls, hotels, and bars. He also said the Government would bar unvaccinated people from boarding matatus.

Already Yaya Centre and Sarova Hotel had issued a directive to their customers that they will not be allowed within their premises from December 21 without a vaccination certificate.

The ruling followed a petition by city Lawyer Harrison Kinyanjui who argued that the directive was discriminatory and unconstitutional. The suspension will remain in place until the case is heard and determined.
