Kenya on the Brink: How The Acting Police IG’s Defiance Of The Constitution Incites Public Anarchy

In recent weeks, Kenya has witnessed an alarming disregard for the rule of law by none other than the acting Inspector General of Police, David Masengeli. His brazen defiance of court orders and outright contempt for the Constitution threaten to push the country toward lawlessness. It is critical to understand that the very institution charged with enforcing the law is now leading the country into a state of disorder and disobedience, setting a perilous example for the public.
The Rule of Law Under Siege
The Constitution of Kenya, specifically Article 10, outlines the national values and principles of governance, including the rule of law, democracy, and constitutionalism. These values bind all state officers, including the acting Inspector General of Police. Yet, Masengeli’s actions demonstrate a blatant disregard for these principles, fostering a culture of impunity that undermines the foundation of Kenya’s democratic governance.
Defiance of Court Orders
Court orders in Kenya are not suggestions but legally binding directives that ensure justice is served and the rule of law is maintained. Article 160(1) of the Constitution enshrines the independence of the judiciary, mandating that its decisions are respected and enforced. Masengeli’s refusal to comply with judicial orders, whether they pertain to police conduct or any other matter, sends a dangerous message: that those in power can pick and choose when to follow the law.
Erosion of Public Trust
The police service is meant to serve and protect the public under Article 244 of the Constitution, which mandates that the National Police Service adheres to the highest standards of professionalism and discipline. However, when the acting police chief flagrantly ignores court rulings, it erodes public trust in the very institution designed to safeguard their rights.
Inciting Anarchy
Masengeli’s actions do not merely violate the Constitution; they actively incite disobedience and lawlessness among the public. When the head of a critical security institution chooses to ignore legal processes, what is to stop the average citizen from following suit? In this sense, Masengeli is inadvertently giving the public a green light to rebel against authority.
A Mad Max Society in the Making
Kenya now stands at the precipice of anarchy, resembling the dystopian chaos depicted in the film *Mad Max: Fury Road*. Lawlessness has become the order of the day, with the political elite—many of whom have been accused of corruption, sexual offenses, and theft—further exacerbating the crisis. The police, once the bulwark against such chaos, now appear to be complicit in the breakdown of societal order.
A History of Impunity
Kenya’s history is replete with instances of state impunity, but what we are witnessing today is unprecedented. When high-ranking officials, such as the acting police IG, openly flout the law, it emboldens other sectors of government and society to follow their example. It is no surprise, then, that the civil service has become a cesspool of corruption, as government officials take cues from their leaders’ lawlessness.
Civil Service Corruption: Following the Lead of the Police
The civil service, designed to implement policies and uphold the law, has instead mirrored the corrupt actions of political and security leaders. Civil servants are now looting public resources with reckless abandon, knowing full well that there are no consequences for their actions. After all, if the head of the police can disobey the courts, why should they be held to a higher standard?
Public Disorder: A Predictable Outcome
Article 37 of the Constitution guarantees the right to peaceful assembly, but it also emphasizes that such assemblies must be conducted within the framework of the law. However, when the police themselves disregard the law, what incentive is there for citizens to adhere to it? Masengeli’s actions are not just defiance; they are a direct incitement to chaos.
The Chain of Lawlessness
The ripple effects of Masengeli’s actions are being felt across the country. From small towns to major cities, the disregard for the rule of law has taken root. Citizens, witnessing the police’s failure to respect the judiciary, are increasingly tempted to take the law into their own hands. Vigilante justice, theft, and mob violence have surged, as the public no longer believes in the fairness of the legal system.
Constitutional Responsibility of the Police
According to Article 245 of the Constitution, the National Police Service is required to work under the direction of the courts and the independent offices that supervise law enforcement. The acting police IG’s refusal to heed these mandates is a violation of his constitutional duty and a betrayal of the oath he swore to uphold.
Where Is the Oversight?
It is disconcerting that neither the Executive nor Parliament has taken meaningful action to hold Masengeli accountable. The Constitution vests the National Assembly with the power to oversee the conduct of public officers, including the police (Article 95). Their silence on this matter amounts to complicity, allowing the acting IG to continue his unconstitutional behavior unchecked.
A Call for Judicial Intervention
Kenya’s judiciary, while independent, cannot function effectively if its decisions are routinely ignored by the executive branch and its agencies. It is imperative that the courts assert their authority by holding the acting police IG in contempt, ensuring that no one, not even the highest-ranking officials, is above the law.
The Political Class: Aiding and Abetting Lawlessness
Kenya’s political class is as much to blame for the current state of affairs as Masengeli himself. Many politicians have come to power through dubious means, often violating election laws and engaging in widespread corruption. These are the very same individuals who have allowed Masengeli to act with impunity, as they benefit from a weakened and lawless state.
Civil Disobedience: A Dangerous Precedent
When public officials openly violate the law, they encourage civil disobedience on a grand scale. Citizens, frustrated with the lack of accountability, are increasingly likely to engage in acts of protest and rebellion. Unfortunately, without the rule of law to guide such actions, this disobedience often descends into violence.
Human Rights at Risk
The Constitution guarantees the protection of human rights, including the right to life, dignity, and security of the person (Article 26). However, these rights are under threat when the police—tasked with upholding them—become agents of lawlessness themselves.
Public Safety in Jeopardy
With the acting police IG at the helm, Kenya’s streets have become more dangerous. The rise in violent crime, extrajudicial killings, and police brutality is a direct consequence of the breakdown in the rule of law. The public, no longer confident in the police’s ability to maintain order, has been left to fend for itself.
A Time for Action
Kenyans must demand accountability from their leaders. Civil society, human rights organizations, and citizens alike must come together to hold the acting police IG accountable. If the current trend continues, Kenya will slip further into chaos, and the public will bear the brunt of this lawlessness.
Restoring the Rule of Law
Kenya cannot survive as a functioning democracy without the rule of law. The judiciary must reassert its authority, and Parliament must exercise its oversight role to restore order. If the acting police IG is allowed to continue in his unconstitutional ways, the very fabric of the nation will unravel.
