What it will take for one of the 8 competing candidates to be declared winner and 5th president of Kenya

Article 138(4) of the Constitution of Kenya 2010 stipulates what the winning presidential candidate in the forth- coming general elections of August 8,8, 2017 in the  first round must score to be declared the 5th President of Kenya and being:

           “A candidate shall be declared elected as president if the candidate receives

(a)    More than half of all the votes cast in the elections

(b)   At least 25 percent of the votes cast in each of more than half of the 47 counties.”

Article 138 of the Constitution is anchored on “how many of those registered voters turn up on August 8,8,2017 to vote”. So that if out of the 19,611,423 eligible voters registered voters only 10 Million turn out to vote, then the person to clinch the Presidential seat will be the one who gets at least 5,000,000 plus one votes and also gets at least 25 percent of votes cast in at least 24 Counties.

The contest for the Presidential seat will thus be determined by the total number of votes cast countrywide to determine what of those total votes constitute 50 percent plus one vote and then next the total votes cast in each of the 47 counties to determine if the candidate with 50 percent plus one vote also has at least 25 percent of the votes in 24 Counties. So each valid vote cast will matter in who becomes the 5th President of Kenya after the August polls.

Eight candidates are contesting for the presidency – Uhuru Kenyatta of Jubilee Party, ODM’s Raila Odinga, Cyrus Jirongo of the United Democratic Party (UDP), Ekuru Aukot of Thirdway Alliance, Abduba Dida of the Alliance for Real Change (ARC), and Independent candidates Joseph Nyagah, Michael Wainaina and Japheth Kavinga.
