Daizy, Guard Who Asked CS Matiang’I To Queue Loses Court Battle After Sacking

The fateful day of 5th April 2017 will forever remain ingrained in the mind of one Ms. Daizy Cherogony who was once an employee at the Jomo Kenyatta International Airport until Cabinet Secretary Fred Matiang’i crossed her path while on duty.

Daizy Cherogony’s only undoing was to request CS Matiang’i to queue as is expected of job description only that Matiang’i was too mighty that requesting him to do so amounted to her loss of employment.

“It was 5th of April 2017, passengers were shouting when I noticed Dr. Matiang’i whom I asked to queue for a security check,” Daizy said in a previous interview.

Daizy was soon to be fired from her post at the Jomo Kenyatta International Airport by the Kenya Airports Authority for what was termed as disrespect to Matiang’i.

With no job, Daizy sought justice to the courts terming the sacking too hefty but today, the 18th of February 2020, the courts have maintained that Daizy was justly fired for requesting CS Matiang’I to queue.

Diazy’s case has been dismissed by the courts today through Justice Nzioki Wa Makau whose judgment is simply telling Kenyans,” You Should Know People’.

Justice Nzioki wa Makau dismissed Ms. Daizy Cherogony’s case, saying the improper handling of Dr. Matiang’i, then Education CS was a sufficient reason for the Kenya Airports Authority to initiate disciplinary action against her.

“She was heard in terms of Section 41 and her rights under Article 41(1) safeguarded. Since there was cause for the dismissal and basis for summary dismissal on account of gross misconduct, the suit is only fit for dismissal,” the Judge said.

Daizy had sued KAA, terming her sacking was unlawful and that she was victimized by her former employer and wanted to be sought to be paid 2.4 million shillings for the sack.

Despite arguing that she had not violated any of the KAA’s regulations and procedures, Daizy’s case was thrown out leaving her jobless.

KAA said as an employee, Daizy was required to be disciplined, respectful and courteous to clients but her actions caused a delay in departure of the flight by 32 minutes and she did not give any plausible explanation.
