KUPPET Intensifies Protests As TSC Threatens Disciplinary Action

The ongoing teachers’ strike led by the Kenya Union of Post-Primary Education Teachers (KUPPET) shows no signs of stopping as today its members strike in Nairobi.

On Thursday, 29th August, KUPPET wrote to the TSC expressing willingness to negotiate. The Teachers Service Commission (TSC) rejected KUPPET’s request to end the ongoing strike.

In a letter addressed to the KUPPET Secretary Akelo Misori, TSC maintained that the union must call off the work boycott in compliance with the court order issued on Tuesday calling off the strike.

KUPPET indicated in the letter dated August 29 that it is unwilling to continue engaging TSC in a long-drawn face-off, particularly in light of the court’s pronouncement on the industrial action.

“In light of the fast-moving dynamic of the strike, particularly the proceedings instituted in court by the commission, we would wish to handle the matters with you to avoid any protracted battles,” the letter addressed to TSC CEO Nancy Macharia reads.

KUPPET informed TSC that they are ready for the meeting on Thursday afternoon to address their demands amicably and without prejudice.

On Wednesday, 28th August, KUPPET directed their teachers to continue with their strike, in total defiance of a court order issued on Tuesday, 27th that required them to report to work after the commission moved to court.

“Pending hearing and determination of the application inter parties, an order of temporary injunction is granted to the petitioner, restraining the respondent, its officials, members, and employees from withdrawing labor or participating in industrial action,” Justice James Rika said.

TSC has directed its officers to collect school attendance data, and to take disciplinary action, against teachers on strike, despite a court order. This emerged as teachers on the TSC payroll started receiving their August Salaries on Thursday, 29th August with the majority expected to have been fully paid by Friday, 30th August.

The salaries, which have been backdated to July 1, are enhanced in line with the second phase of the 2021-2025 Collective Bargaining Agreement that teachers have demanded implemented.

On Tuesday, 27th August, teachers from two secondary schools in Machakos were forced to flee after angry KUPPET demonstrators stormed the institutions. The demonstrators had gotten reports that some of the colleagues, were teaching in classrooms when the union had directed its members, to down their tools.

According to the reports, KUPPET officials walked in and demanded to know why their colleagues defied the official position requiring members to participate in the nationwide strike. Police officers from Machakos Police Station were forced to intervene and block them from creating a disturbance.
