Court Stops Nairobi Gubernatorial By-election

The High Court in Nairobi has stopped the by-election for Nairobi County until a case filed by Mike Sonko is heard and determined. How long this will take is not known but must be within the 60 days set by the Constitution for a by-election.

The Independent Electoral and Boundaries Commission had announced that the by-election will take place in February this year but that might not happen if the case will take longer. Contestants were prepping to start their campaigns.

The gubernatorial position fell vacant after the then Governor Mike Sonko was impeached by both the county assembly of Nairobi and the Senate over gross misconduct including misuse of public funds and use of unprofessional language.

Mike Sonko became the third Governor to be successfully impeached after Martin Wambora of Embu, and Ferdinand Waititu of Kiambu. Anne Waiguru of Kirinyaga was let off the hook by the Senate after she was impeached by her County Assembly.

Martin Wambora, branded one with 9 lives of a cat managed to find his way back through the court. Is Mike Sonko planning to pull a Martin Wambora through the High Court? Only time will tell.

If a Governor is impeached, a Deputy Governor is supposed to be sworn in and take over as Governor. Mike Sonko did not have a Deputy Governor and of such, the Speaker of the County Assembly is sworn in as Governor for 60 days.

The case filed by Mike Sonko should be heard and determined before the 60 days because a by-election must be held then.

President Uhuru Kenyatta formed the Nairobi Metropolitan Service to take over the control of the city after it became evident that Mike Theatrics were affecting service delivery.

Major General Muhammed Badi has been hailed with transforming the city including sinking at least 90 boreholes in informal settlements.
