You Will Be Fined Ksh 100,000 For Filing False Tax Returns

A person who makes a false statement or omits any information required to be included in an information return under 6B shall be liable to a penalty of 100,000 shillings for each such false statement.

If the Finance Bill that is before parliament sails through (which it seems it will sail through), you will be fine 100,000 shillings for filing false tax returns or for presenting incomplete information to the Kenya Revenue Authority (KRA).

The same bill recommends a jail term of up to three years for people who will fail to file their returns on time, present false or incomplete information to the Kenya Revenue Authority (KRA). Kenyans feel the bill is out to finish them.

“A person who makes a false statement or omits any information required to be included in an information return under 6B shall be liable to a penalty of 100,000 shillings for each such false statement or omission to imprisonment for a term not exceeding three years,” says the Bill.

If approved by parliament, the law will take effect in July this year and will get millions of Kenyans and businesses off-guard. Currently, businesses and individuals are struggling to beat the June 30 deadline for filing their tax returns as directed by KRA.

At the same time, Kenyans are set to lose their Kenya Revenue Authority (KRA) pins for failing to file their returns before the June 30th deadline.

According to a new notice published on Monday, the taxman said persons who have already failed to file their respective tax returns without showing cause will lose their pins after the lapse of a 30-day window.

After the deadline lapses, the authority announced that it would begin the process of deregistering the PIN holders and erasing their data from the national servers.

On its website, the tax collection agency has listed 62,727 pins intended for de-registration in the next month.
