List Of Kenyan ICC Witnesses Killed Or Disappeared
KEY POINTS
Others include Njoroge Gichere who disappeared in 2008, Timothy Mburu Gatira (2008), Njuguna Gitau Njuguna (2009), George Njoroge Wagacha alias “Afco”(2008), Joseph Kang’ethe alias Maina Diambo (2008), and journalist John Kituyi who was allegedly killed for his reporting on the death of a witness in the ICC proceedings.
The mysterious death of a Kenyan lawyer Paul Gicheru has raised speculations among Kenyans. According to police, Gicheru had a late lunch after which he felt unwell.
Police said he took a nap but he did not wake up. Gicheru was facing charges of interference with witnesses at the International Criminal Court (ICC) in the case against President William Ruto and journalist Joshua Sang over the 2007 post-election violence.
Paul Gicheru now joins a team of other ICC persons of interest who perished in unclear circumstances and others still living as fugitives. In 2015 the body of ICC witness Meshack Yebei was found at the Tsavo national park. Yebei was reportedly abducted in late December 2014 at his home in Eldoret where he had gone to visit his family. He was expected to testify in the case against President William Ruto.
Mr. Yebei is said to have publicly stated that he received death threats before his disappearance and subsequent death under mysterious circumstances. An autopsy revealed that he was hit on the head with a blunt object. It is not clear whether he had already testified at the International Criminal Court located at the Hague in The Netherlands by the time he was murdered.
In 2016 during a requiem Mass of the late businessman, Jacob Juma at the All Saints Cathedral in Nairobi, opposition party leader Raila Odinga exposed the names of people he claimed were eliminated during the International Criminal Court (ICC) cases linked to the 2007/08 post-violence elections.
“There is a system, a way of life and philosophy in this country that believes in murders; that produces murderers in Kenya; that believes, wrongly, in extra-judicial killings. In the aftermath of the Post-Election Violence, a chain of witnesses were systematically eliminated through extra-judicial killings,” Odinga said.
According to Odinga, some individuals who vanished mysteriously include Meshack Yebei who was found dead in 2015, Charles Ndungu Wagacha and Naftali Irungu alias “Marcus” both killed in 2008, Anthony Mwenje alias “Noriega” who was allegedly arrested by police in May 2009 and subsequently disappeared.
It is however unclear whether all those people mentioned by Raila were ICC witnesses.
The whereabouts of two Kenyans – journalist Walter Osapiri Barasa and Philip Kipkoech Bett alias “Kipseng’erya” remain unknown. Both were wanted by the International Criminal Court (ICC) for interfering with witnesses. They were to face a criminal trial at the ICC alongside other suspects from various countries.
